1. Definitions
1.1 In these terms and conditions the following words shall have the meanings set out below:
“Event” means an event including, without limitation, a concert, exhibition, television recording, theatrical and/or music event to be held at a venue.
“We” means St. James Theatre.
“You” means you or anyone in our reasonable opinion to act on your behalf.
“Theatre” means the St. James Theatre of 12 Palace Street, SW1E 5JA.
“Contract” means any contract for the purchase of Tickets made between you and the Theatre.
“Confirmation” means the confirmatory note sent to you by the Theatre setting out the following details:(i) your booking reference;(ii) details of all Tickets purchased, including the event, venue, date, seat number and position; and(iii) the contract price.
“Tickets” means tickets offered for sale by the Theatre to you on behalf of the organisation responsible for the Event for the right to occupy space at or to attend an Event.
“Restaurant” means the Carrara Restaurant located on Level 1 of the St. James Theatre
2. The Contract Between You and Us
2.1 These terms and conditions govern all Contracts.
2.2 Contract with the Theatre will be concluded upon completion of the Booking Form (including, for the avoidance of doubt, the provision of your credit or debit card details) shall confirm our acceptance of your offer to purchase the Tickets, subject to these terms and conditions.
2.3 The prices and availability of the Tickets are specified on Theatre’s website and the Theatre is not obliged to conclude any Contract on these terms.
2.4 You are entirely responsible for entering your details correctly on the Booking Form. You warrant that all details supplied by you are true and accurate.
2.5 It is your responsibility to check that the Tickets issued to you are accurate.
2.6 Where a person makes a booking on behalf of a party, that person accepts these terms and conditions on behalf of all members of the party and is responsible for all payments due from the party.
2.6 Booking services with the Theatre are only available to persons who are at least 18 years of age. By submitting a Booking Form you confirm that you comply with such requirements.
2.7 The Theatre reserves the right to place restrictions on the volume of any Tickets ordered.
3. Terms of Payment
3.1 All Tickets must be paid for in full at the time of booking including any applicable delivery charges.
3.2 A £1.50 transaction fee will apply to all online and phone bookings. This does not apply when purchasing tickets at the box office, or to our Friends and Members.
4. Delivery
4.1 The Theatre shall use reasonable endeavors to post all Tickets to you (or to the billing address of the credit/debit card holder if they are not one and the same) within 3 working days of making a booking, providing post was chosen as a delivery option in the Booking Process and it is more than 7 days prior to the event.
4.2 Tickets will be posted to you by Royal mail. The Theatre will not, however, accept any responsibility for documents mislaid or lost by the Royal Mail.
4.3 If you book Tickets for an event which will take place within 7 days of the date of the booking, your Tickets must be collected by you from the Theatre box office.
5. Alterations and Cancellations
5.1 The Theatre does not permit Tickets to be refunded after purchase, except where a performance has been cancelled or abandoned when less than half the performance has taken place. Where monies are refunded, such refunds are limited to the face value of the Tickets purchase. The postage fee, if applicable, is nonrefundable.
5.2 Resale of tickets. You are not entitled to resell any tickets for more than the face value of the Ticket. Tickets may be re-sold by the venue if/when the performance is completely sold out. You may contact the box office to be placed on a re-sale list.
5.2.1 Tickets are never guaranteed to be re-sold. Tickets will only be available for re-sale once all other seats have been sold (including House Seats, Agency Seats and Production Seats).
5.3 All Tickets are sold subject to the Theatre’s right to make any alterations in the cast or arrangements advertised on the Theatre’s website or elsewhere which are rendered necessary by an unavoidable cause.
6. Liabilities of the Theatre
6.1 Subject to Clause 5.1 below, the Theatre will only be liable to you for direct losses arising as a result of:
(i) a breach of these terms and conditions by the Theatre; and
(ii) any fraudulent statement or negligent act by the Theatre arising under or in connection with the Contract.
6.2 The Theatre’s total liability under clause 5.1 above shall be limited to the total face value of the Tickets.
6.3 Nothing in this Clause 6 or these terms and conditions excludes or limits the liability of the Theatre for death or personal injury caused by the Theatre’s negligence or for fraud.
6.4 The Theatre will not be liable in any way if an event or performance is abandoned after more than half of it has taken place due to any factors which are beyond the Theatre’s reasonable control. Without limiting the foregoing, the following shall be regarded as causes beyond the Theatre’s reasonable control:
(i) acts of God, which include earthquakes, cyclones, storms, flooding, fire, disease, fog, snow or frost;
(ii) force majeure which includes war, accidents, acts of public enemies, strikes, embargoes, perils of the air, local disputes and civil commotions;
(iii) Power failure and failure of sound or lighting equipment.
7. Data Protection
The Theatre will collect, use, store and disclose your personal details in accordance with the Data Protection Act.
8. Entire Agreement
It is the intention of the Theatre that all terms of the Contract between the Theatre and you are contained in these Terms and Conditions. If you wish to rely on any variation of these terms, you must ensure that such variation is in writing and signed by you and on behalf of the Theatre before any Contract is made.
9. Severability
If any part of these terms and conditions are not enforceable then this will not affect the enforceability of any other part.
10. Safety and Enjoyment
10.1 The Theatre reserves the right to refuse admission and may request any Ticket holders to leave (taking any such appropriate action which it considers to be necessary to enforce this right) before or during performances if it considers it to be necessary or desirable to do so. The Theatre may also, on certain occasions, have to conduct security searches to ensure your safety.
10.2 Every effort will be made by the Theatre to admit latecomers at a suitable break in the event or performance.
10.3 The Theatre cannot permit canned or glass containers to be brought into the auditorium.
10.4 Mobile phones, pagers and watches must be silenced before entering the auditorium.
10.5 To be admitted you must be in possession of a valid Ticket.
10.8 Strobe lighting, smoke effects and gunshots are sometimes used in productions.
10.9 The Theatre or any permitted third parties may carry out general filming and sound recording in or about the venue. By purchasing Tickets you consent to you and your party being included in and to the exploitation of such films and recordings without payment.
11. Governing Law
These terms and conditions and any Contract concluded incorporating these terms and conditions shall be governed by English Law and all disputes shall be submitted to the non-exclusive jurisdiction of the English Courts.
12. Restaurant Bookings
11.1 All bookings are made through OpenTable Reservations system on behalf of the St. James Theatre & Carrara Restaurant.
11.2 All bookings are not confirmed until a confirmation email has been received.
11.3 All advertised prices are subject to change without prior notice, and the restaurant are under no obligation to honour any previously advertised prices and/or deals.
11.4 Upon booking you are agreeing to these terms of service.
Ticket Terms and Conditions
St. James theatre (SJT) reserves the right to make alterations to the advertised time, programme or cast without being obliged to refund monies or exchange tickets.
Tickets cannot be refunded unless a performance is officially cancelled. If a performance is cancelled ticket holders will be offered alternative performances (subject to availability) up to the seat value on the ticket or a refund of the price paid for the seat element. SJT will not be liable for any additional expenses incurred by customers in the event of a cancelled performance.
Full price tickets may be exchanged at SJT’s discretion for an alternative performance of the same production up to 48 hours prior to the performance time, subject to a per ticket administration fee. It is not possible to exchange discounted tickets.
Every member of the audience, including children, must be in possession of a valid ticket in order to gain entrance to the theatre.
Ticket holders only have a right to a seat of the value corresponding to that stated on the ticket and SJT reserves the right to provide alternative seats to those stated on a ticket.
If any tickets are resold or transferred for commercial gain by anyone other than official resellers authorised by SJT then the tickets will become void and the ticket holder may be refused entry to, or ejected from the theatre.
SJT may restrict ticket sales to a maximum number per person or household, and reserves the right to cancel any tickets purchased in excess of this number.
Any comments or complaints regarding the view from a seat or audibility of the performance should be made promptly to a member of St. James Theatre management before or during the performance.
SJT reserves the right to refuse admission in reasonable circumstances. Any customers who are intoxicated or disruptive, abusive or violent to theatre staff, audience members or performers will be ejected from the theatre. In such circumstances, no refund of tickets will be given.
In the interests of other customers, parents or guardians may be asked to remove noisy or disruptive children.
Mobile phones, pagers, digital watches, laser pens or any other electronic equipment should be disabled when inside the auditorium to avoid disturbing the cast and other customers.
Latecomers will only be admitted into the auditorium at a suitable break in the performance, but admission cannot always be guaranteed and exchanges for an alternative performance will not be permitted.
The use of photographic and other recording equipment is strictly prohibited in the auditorium. SJT reserves the right to delete any unauthorised recordings and to eject any customers who are suspected of making recordings in the theatre.
Customers may not bring food or drink in the building other than items purchased at the theatre. SJT reserves the right to refuse to serve alcohol to any customer that appears to be intoxicated and to ask for proof of age prior to serving alcohol.
Security searches may be conducted and SJT thanks customers in advance for the co-operation in helping us to ensure the safety of all customers.
Performances may be recorded on occasion. Ticket holders automatically consent to the filming or sound recording of themselves as audience members. If you have any objections to being filmed or recorded please contact a member of the St. James Theatre management before the performance begins.
SJT does not accept responsibility for the loss or damage of any personal property.
English law and jurisdiction shall exclusively govern all of the above terms and conditions.
